Terms of service
Visit EZEJ Technology and use the products and services we offer.
Before completing the registration procedure or using EZEJ Technology Services in any way, please be sure to carefully read and thoroughly understand the EZEJ Platform Merchant Service Agreement (hereinafter referred to as the "Agreement"), which is governed by the EZEJ Platform (including PC website, mobile website, etc.). The user of the "Platform" or the "EZEJ Platform" (hereinafter referred to as the "User" or "you") and the operator of the EZEJ Platform, namely Shangrao EZEJ Technology Co., LTD. (hereinafter referred to as "EZEJ" or "We"), in connection with the services of the EZEJ Platform and other matters. Choose to accept or not accept these Terms of Service after confirming full understanding; Once you complete the "Agree to the Terms and Register" or otherwise start using the EZEJ Platform, you have read and agree to be bound by these Terms of Service. If you do not agree with these Terms of Service or any of them, you should not proceed further or discontinue the registration process. You undertake to accept and abide by the provisions of this Agreement, and you shall not claim that this Agreement is invalid or require the cancellation of this Agreement on the grounds that you have not read the content of this Agreement or have not obtained the answer to your inquiry.
I. Confirmation of agreement
1.1 The user agrees to all registration agreements/terms/statements and other rules related to the Platform and completes the registration procedure before becoming an official user of the Platform. In order to facilitate your relevant operations on the platform, EZEJ provides you with a virtual fund account (hereinafter referred to as the "EZEJ Treasure" account). The user confirms that this Agreement is a contract dealing with the rights and obligations of both parties and is always valid. If there are other mandatory provisions by law or special agreements between the two parties, such provisions shall prevail.
1.2 After you complete the user registration procedure (including accessing the EZEJ platform in any way to use the services), you will voluntarily accept and officially sign this Agreement, officially become a registered user of EZEJ, and accept all contents of this Agreement. If you do not agree to this Agreement, or have any doubts about the terms of this Agreement, please stop the user registration process immediately, and you can choose not to use the Platform services.
1.3 If you agree to this Agreement, it is deemed that you confirm that you have the corresponding rights and capabilities to enjoy the platform services, place orders and other shopping, and can independently bear legal responsibilities.
1.4 You hereby acknowledge that at the time you complete the registration procedure or actually use the EZEJ Platform to provide you with related services in other ways permitted by the EZEJ Platform, you shall be a natural person, legal person or other organization with full capacity for civil conduct and full capacity for civil rights. If you do not have the above-mentioned qualifications, you and your guardian shall bear all the consequences caused by this, and EZEJ Platform has the right to cancel or permanently freeze your "EZEJ Treasure" account, and claim the corresponding losses from you and your guardian.
1.5 EZEJ Platform reserves the right to refuse service, close user accounts, remove or edit content and cancel orders in its sole discretion to the extent permitted by the laws in force in the territory of the People's Republic of China.
1.6 EZEJ has the right to revise all or part of the terms of this Agreement and other service rules of EZEJ Platform from time to time in accordance with the relevant laws, regulations and relevant policies and changes of the People's Republic of China and the needs of the operation of the Platform, and we will announce changes to the revised agreement and/or contents by way of publication on the website. Once published on the EZEJ platform, this announcement will automatically take effect at a specified time and replace the original agreement. You can check the latest agreements at any time on the EZEJ platform; You are obligated to pay attention to and read the latest version of the Agreement and platform rules, privacy terms, announcements, after-sales policies, etc. If you do not agree to the revised Agreement, you may immediately stop receiving the services provided by EZEJ under this Agreement; If you continue to use the services provided by EZEJ, you will be deemed to agree and accept the revised agreement. EZEJ recommends that you carefully read this Agreement and other announcements posted on the EZEJ Platform before using the Platform. If any provision of this Agreement is held to be invalid, void or for any reason unenforceable, such invalid provision shall be deemed to be severable and shall not affect the validity and enforceability of the remaining provisions, and the invalidity of any single provision shall not deny the validity of all provisions.
1.7 Unless expressly stated otherwise, the EZEJ Platform Services include any Internet-based and mobile network related services provided by EZEJ (and its subsidiaries) and other affiliates and are subject to this Agreement. If you do not agree to the terms of this Agreement, you should immediately stop the registration/activation process or stop using the services provided to you by the EZEJ Platform.
1.8 This Agreement includes the body of the Agreement and all kinds of rules, terms and announcements that have been published or may be published or updated on the EZEJ platform in the future, including but not limited to: Privacy Policy, After-sales Policy, Logistics Instructions, Return and Exchange Terms and Conditions. All rules, terms, instructions and announcements published on this platform are an integral part of this Agreement and have the same legal effect as the body of this Agreement. Before you apply to register as a registered member of EZEJ, please read the text of this Agreement and the above terms and conditions carefully.
2. Service Instructions
2.1 EZEJ Platform provides users with Internet information and other services through the Internet in accordance with the law. Users shall have the right to use relevant services of the Platform if they fully agree to this Agreement and provisions of EZEJ Platform.
2.2 The User must prepare the following equipment and bear the following expenses:
(1) Internet access equipment, including but not limited to: computers or other Internet access terminals, modems and other necessary Internet access devices;
(2) Internet access expenses, including but not limited to network access fees, Internet access equipment rental fees, mobile phone traffic fees, etc.
2.3 In order to provide you with better products/services and experience, we may provide your real name authentication information, including name, ID number, mobile phone number or bank card number, to third party service agencies entrusted by us for verifying the authenticity of the authentication information provided by you. You understand and agree that the third party services we work with may use your information for comparison with external legitimate databases to obtain verification results. To ensure the security of your information, we require our third party partners to have sufficient data security capabilities and provide an adequate level of security protection. Without your consent, we will not use the information you provide for any other purpose that you have not explicitly authorized.
2.4 The "EZEJ Treasure" account provided to you by EZEJ Platform is only used for your pre-recharge and settlement operations with EZEJ Platform. Ownership of the funds/property in your "EZEJ Treasure" account is yours. The specific settlement payment is based on the amount of your actual transaction on the EZEJ platform.
2.5 The EZEJ platform helps you connect with actual manufacturers/factories and logistics providers to assist you with fund settlement operations. The transfer of funds in this account is an operation that the EZEJ Platform assists you in making the transfer or refund according to the rules of the Platform and the transaction data that you actually took place.
2.6 All expenses incurred by you on the EZEJ Platform in connection with the above transactions will not be interfered with by the EZEJ Platform and are transactions between you and the manufacturers/factories and logistics providers on the platform voluntarily. None of the transactions resulting from these operations are related to the EZEJ platform.
2.7 In order to facilitate your use and provide you with a more satisfactory service experience, EZEJ Platform provides you with EZEJ membership (personal edition and enterprise edition) services. You can choose to upgrade the service voluntarily according to your own needs, and the EZEJ platform does not interfere with your choice.
2.8 When you use the EZEJ platform to withdraw money, the EZEJ Platform will charge you a certain amount of withdrawal fees based on the amount of money you withdraw.
2.9 The membership upgrade fee you voluntarily pay to EZEJ Platform and the related handling fee deducted from the withdrawal operation are the real transaction amount between EZEJ Platform and you, which is the actual income of EZEJ Platform and will eventually be transferred to the public account of EZEJ Platform.
3. "EZEJ Treasure" account registration and use
3.1 Before you start the registration process to use the EZEJ Platform services, you shall have the civil capacity required by the laws of the People's Republic of China to suit your actions. If you are a minor or do not have the aforementioned capacity for civil conduct appropriate to your actions, you and your guardian shall bear all the consequences caused by this in accordance with the law.
3.2 After you fill in the information according to the prompts on the registration page, read and agree to this Agreement and complete all registration procedures, you can obtain the "EZEJ Bao" account and become an EZEJ Platform user. You undertake to provide registration information to EZEJ in good faith, and the registration information provided is true, accurate, complete, legal and valid. If EZEJ Platform, in its own independent judgment, believes that the information provided by you is wrong, untrue, outdated or incomplete, we have the right to send you a notice to inquire and/or request correction, and have the right to directly delete the relevant information, until suspending/terminating the provision of part or all of the relevant services to you. EZEJ Platform assumes no responsibility for this and you will be liable for any direct or indirect losses and adverse consequences arising therefrom. If your registration information changes, you should update your registration information promptly. If EZEJ fails to contact you according to the last information provided by you, you fail to provide information in a timely manner as requested by EZEJ, or the information you provide is demonstrably untrue, you will be liable for all losses and economic consequences caused to yourself, others and EZEJ. EZEJ reserves the right to terminate your use of the services of EZEJ Platform if the registration information you provide is illegal, untrue, inaccurate, unknown, etc.
3.3 You have the right to log in to the EZEJ Platform using the EZEJ member name, mobile phone number (hereinafter referred to as "Account name") and password (account name and password collectively referred to as "Account") that you have set or confirmed, and you can use your "EZEJ Treasure" account to apply for registration as the creator of the EZEJ Platform.
3.4 In the event that EZEJ, as a platform service provider, is required by law to verify the information of some users (such as creators, etc.), EZEJ will check and verify your information from time to time in accordance with the law, and you shall cooperate to provide the latest, true and complete information.
3.5 Since the User "EZEJ Treasure" account is associated with the user's credit information, you may transfer the user "EZEJ Treasure" account only when there is a legal provision, judicial ruling or consent of EZEJ, and in accordance with the procedures for the transfer of the user "EZEJ Treasure" account stipulated in the rules of the EZEJ Platform. Once your "EZEJ Treasure" account is transferred, the rights and obligations under the account are transferred. In addition, your "EZEJ Treasure" account may not be transferred in any way, otherwise all liabilities arising therefrom shall be borne by you.
3.6 If your "EZEJ Treasure" account meets one of the following conditions, EZEJ has the right to withdraw your "EZEJ Treasure" account, your "EZEJ Treasure" account will no longer log in to the EZEJ platform, and the corresponding service will be terminated:
* has not been used to log into the EZEJ platform for 12 consecutive months;
* The "EZEJ Treasure" account name you set infringes or is suspected of infringing on the legitimate rights and interests of others;
* You have registered or used multiple "EZEJ Treasure" accounts;
* You transfer EZEJ Treasure Account in any form, authorize others to use your EZEJ Treasure account, and trade EZEJ Treasure Account with others;
* You have maliciously processed orders for goods and services, maliciously protected rights and other acts that disrupt the normal trading order of the EZEJ platform;
* When your "EZEJ Treasure" account is determined to be an abnormal account by the EZEJ Platform;
* You take the initiative to apply to EZEJ to cancel the "EZEJ Treasure" account;
* You use the platform for illegal trading, trading, in violation of the relevant laws and regulations of the People's Republic of China and relevant policies;
* The EZEJ Platform suspends/terminates the provision of services to you in accordance with the requirements of the relevant departments/government agencies of the relevant countries;
* Any other action to suspend/terminate the provision of the Services to you as a result of your engaging/suspected engaging in other acts that may involve infringement of the legitimate rights and interests of the EZEJ Platform and/or others.
4. "EZEJ Treasure" account management
4.1 The "EZEJ Treasure" account is owned by EZEJ and you only have the right to use it. In order to protect your rights and interests, when you set the password for your account, do not use a simple password with repeated or consecutive numbers. Please keep your password safe and do not inform others of your password. All losses caused by poor password storage (such as your active disclosure or attacks by others, fraud, etc.) shall be borne by you.
4.2 EZEJ allows only one "EZEJ Treasure" account per user. If there is evidence to prove that you have registered or used multiple "EZEJ Treasure" accounts, EZEJ has the right to freeze or close accounts, cancel orders, refuse to provide services and other measures, such as causing losses to EZEJ platform and related parties, you shall also bear the corresponding liability for compensation.
4.3 You hereby confirm and warrant that the name (including user name, nickname, etc.) and avatar used in your account shall not violate the relevant laws, regulations and policies of the People's Republic of China, and do not infringe or suspected of infringing the legitimate rights and interests of others. If EZEJ believes that the content you set is suspected of infringing the legitimate rights and interests of others, EZEJ has the right to require you to make changes/changes within a limited time or directly terminate the service for you without notice, forcibly change your name and avatar, and directly cancel your "EZEJ Bao" account if necessary, depending on the seriousness of the circumstances.
4.4 You have the rights and responsibilities in accordance with the law for all activities, acts and events carried out through your EZEJ Account, and may not transfer your EZEJ Account in any form, authorize others to use your EZEJ Account, or trade your EZEJ Account with others.
4.5 In view of the particularity of network services, EZEJ has no obligation to check whether you use the user name and password, but only whether the user name and password are consistent with those saved in the database. As long as the user name and password entered are consistent with those saved in the database, anyone can log in with the user name and password and obtain various services provided by EZEJ. Therefore, even if you believe that your account login is not your own action, EZEJ will not be liable for any resulting. If you find any unauthorized use of your EZEJ account and password, or any other possible misappropriation or disclosure of your account information, you shall immediately notify EZEJ Platform, and EZEJ Platform shall take relevant measures to prevent further loss;
4.7 When your "EZEjbao" account is judged to be an abnormal account (the specific determination criteria shall be determined by the relevant departments of the Platform), the Platform has the right to cancel the order, do not provide platform after-sales service (including time-limited compensation, etc.), close the "EZEjbao" account and other measures; If your account causes losses to the Platform and related parties, EZEJ reserves the right to pursue compensation. If you have any objection to the operation of EZEJ platform, you can timely feedback to EZEJ platform, we will deal with your questions in the first time.
4.8 If you submit an application to EZEJ for cancellation of the "EZEJ Bao" account and EZEJ Platform reviews and agrees, EZEJ shall cancel the user's "EZEJ Bao" account, and this Agreement shall be terminated. The User understands and agrees that even after the termination of this Agreement and the cancellation of the User's "EZEJ Treasure" account, EZEJ shall have the right to:
* Keep your registration information, "EZEJ Treasure" account information and all past transaction records;
* If you have violated the law or this Agreement on EZEJ before the account is cancelled, EZEJ may still exercise the rights set forth in this Agreement to claim against you for your violation of laws and regulations, this Agreement and the rules of the Platform during the use of EZEJ Platform services.
4.9 EZEJ may unilaterally terminate this Agreement by cancelling the account of User "EZEJ Bao" in the following cases:
* EZEJ reserves the right to suspend or terminate the Service provided to you if you breach the relevant provisions of this Agreement. If you register as an EZEJ Platform user again, directly or indirectly or in another person's name, after EZEJ has suspended or terminated the provision of the Services, EZEJ has the right to suspend or terminate the provision of the Services to you again;
* If you use illegal or false content to fill in user information, EZEJ has the right to immediately terminate the service provided to you;
* When this Agreement is modified or updated, if you indicate that you do not want to accept the new service agreement, EZEJ has the right to terminate the service provided to you;
* Compliance with the provisions of Article 3.6 of this Agreement;
* Other circumstances in which EZEJ considers it necessary to terminate the provision of the Service.
4.10 When your "EZEJ Treasure" account involves a refund, you need to carry out real-name authentication through the EZEJ platform and provide true, accurate, complete, legal and valid information, and refund will be made after EZEJ's review and confirmation, otherwise EZEJ has the right not to refund; EZEJ shall not be liable for any loss caused by any inauthenticity, inaccuracy, incompleteness, illegality or improper storage of account information (such as disclosure by you or attack by others, fraud, etc.). In case of any loss caused to the EZEJ Platform and related parties, all responsibilities will be borne by you.
5. Protection of personal information
5.1 EZEJ attaches great importance to the protection of users' personal information (that is, information that can identify users independently or in combination with other information). When you use the services provided by EZEJ, we consider that you have consented to the collection, storage, use, disclosure and protection of your personal information by EZEJ in accordance with the Legal Notice and Privacy Policy published on the EZEJ platform. EZEJ wants to clearly explain to you how EZEJ treats your personal information through the Legal Notice and Privacy Policy, so EZEJ recommends that you read the Legal Notice and Privacy Policy in its entirety to help you better protect your privacy rights.
5.2 When you browse, customize products and other activities on EZEJ platform, involving your real name/name, correspondence address, contact phone number, email address and other private information provided by you or a third party you provide, EZEJ will keep it strictly confidential, unless authorized/agreed by you or otherwise stipulated by relevant laws, regulations or policies of the People's Republic of China. EZEJ will not disclose your private information to the outside world.
5.3 You agree that EZEJ has the right to inform you of the Platform's promotional activities and other information by email, SMS, telephone, announcement, etc.
5.4 You agree that EZEJ has the right to use your registration information, "EZEJ Treasure" account name, password and other information to log in to your registered "EZEJ Treasure" account for evidence preservation, including but not limited to notarization and evidence collection, under the authorization/requirement/order of relevant state agencies or government departments and relevant rights organizations for specific purposes.
6. Guarantee and authorization of non-personal information
6.1 You represent and warrant that you have the appropriate and legal rights to the information you post. Otherwise, EZEJ may delete or block the information you post in accordance with the law or in accordance with this Agreement.
6.2 When you use various services provided by the EZEJ platform (including but not limited to customized services), you shall ensure that the content and information you post or upload does not contain the following:
* Violates the prohibitive provisions of the relevant laws, regulations and policies of the People's Republic of China;
* Political propaganda, feudal superstition, obscenity, pornography, gambling, violence, terror, infringement on the rights and interests of minors, instigation of crime or any other violation of public order and good customs;
Fraudulent, false, inaccurate or misleading;
* Information of goods or services prohibited or restricted from sale by the State (unless it has obtained legal and sufficient permission), information of goods or services suspected of infringing on the legitimate rights and interests of others, information of goods or services contrary to the public interest or public morality, or information of goods or services deemed unsuitable for sale on the Platform by EZEJ Platform, and other information suspected of violating the law or violating this Agreement and various rules;
* Infringement of intellectual property rights (including but not limited to Copyrights, trademarks, patents), trade secrets and other proprietary rights of third parties;
* Fabricating or distorting facts and other ways that may infringe the legitimate rights and interests of other users, improperly evaluating other users, improperly creating or improving their own credit rating, improperly creating or improving (reducing) the credit rating of other users;
* Infringe upon the legitimate rights and interests of others by insulting, defaming, intimidating, involving the privacy of others, etc.;
* There are viruses, trojans, crawlers and other malicious software or program codes that may destroy, tamper with, delete or affect the normal operation of any system of EZEJ Platform or secretly obtain the data and personal information of EZEJ Platform and other users without authorization;
* Others that are against the public interest or public morality of the society, or are not suitable for publication on the EZEJ platform according to the provisions of the relevant EZEJ platform agreements, terms and rules.
6.3 For the text, pictures, video, audio and other non-personal information provided and released by you except personal information, you shall guarantee that you have the ownership or use right of the information, and the authorization is in accordance with the relevant laws and regulations of the People's Republic of China and relevant policies. If the relevant information provided by you damages the legitimate rights and interests of others or is held liable by a third party, EZEJ has the right to cooperate with the right holder to submit relevant evidence/supporting materials at the request of the right holder (including but not limited to proof of rights, legal documents and other relevant documents of government authorities). If your infringement causes damage to the EZEJ platform, EZEJ Platform has the right to restrict the operation of your "EZEJ Treasure" account, take measures to close/cancel your "EZEJ Treasure" account, and reserve the right to seek compensation from you if necessary.
6.4 You authorize EZEJ to transfer the information you provide and form in the process of registering the "EZEJ Treasure" account and using the services of EZEJ Platform to the relevant service providers of EZEJ Platform for their use in the process of completing relevant transactions, Or obtain from EZEJ platform related service providers the information you provide and form during the registration, use of the relevant services.
7. Users' words and deeds obligations according to law
7.1 This Agreement is formulated in accordance with relevant national laws and regulations, and you agree to strictly abide by the following obligations when using EZEJ Platform services:
* The transmission of data information from the territory of China to overseas must comply with the relevant laws and regulations of China;
* The EZEJ platform shall not be used for money laundering, stealing business secrets, stealing personal information and other illegal and criminal activities;
* Shall not interfere with the normal operation of the EZEJ platform, shall not invade the platform and the national computer information system;
* Shall not transmit or publish any illegal criminal, harassing, defamatory, abusive, threatening, hurtful, vulgar, obscene, uncivilized and other information;
* Shall not transmit or publish information or statements that harm the national social and public interests and involve national security;
* Engaging in acts of unfair competition, disrupting the normal order of online trading, or engaging in acts unrelated to online trading;
* Not to use any data on the EZEJ Platform for commercial purposes, including but not limited to using any material displayed on the EZEJ Platform in any way, such as reproduction, dissemination, etc., without the prior written consent of the EZEJ Platform;
* Not to remove, conceal or alter in any way/means any patents, Copyrights, trademarks or other rights/interests of EZEJ displayed on or contained in EZEJ Platform;
* Do not express or imply to any third party that there is/may be a cooperative relationship between you and EZEJ Platform, including but not limited to mutual shareholding, business dealings or cooperative relationship, or otherwise cause others to misunderstand;
* Shall not abet others to engage in acts prohibited by this Agreement;
* The "EZEJ Bao" account registered on the Platform shall not be used for illegal profit-making business activities;
7.2 The User shall from time to time pay attention to and comply with various legal rules and regulations published or modified by the EZEJ Platform from time to time.
7.3 EZEJ reserves the right to delete all kinds of information content on the EZEJ Platform that does not comply with legal policies or is untrue without notifying the user.
7.4 If the user fails to comply with the above provisions, EZEJ reserves the right to make an independent judgment and take measures such as suspending or closing the user account. Users are legally responsible for what they say and do online.
8. Product information
8.1 If there is any change in the commodity price, availability and other commodity information on the EZEJ Platform, the Platform will notify you in advance, without excluding notification in the form of announcement, SMS, email, etc. You are obligated to pay attention to and check the notification information from time to time; EZEJ is not responsible for any problems caused by your failure to check in time.
8.2 Due to the huge amount of commodity information on the EZEJ Platform, although the EZEJ Platform will make its best efforts to ensure the accuracy of the commodity information you browse, due to other Internet technical factors and other objective reasons, the information displayed on the EZEJ platform may have a certain lag or error. Please be aware and understand this situation.
9. Trading restrictions
9.1 Some of the products or content displayed on the EZEJ platform may be restricted for purchase and use by minors. If we find that minors purchase and use restricted products or content, we have the right to cancel the order, freeze, close the "EZEJ Treasure" account and other measures.
9.2 If you cancel your order several times without valid reasons, EZEJ reserves the right to take measures to freeze and close the account, and reserves the right to pursue liability.
9.3 If EZEJ finds that you have engaged in other violations of the Service Agreement, or if EZEJ believes that you have engaged in malicious transactions or abnormal transactions (such as imitating, copying or selling EZEJ Platform products on any other platform and infringing the intellectual property rights of products), EZEJ reserves the right to cancel orders, freeze or close product sales rights and accounts (including VIP service accounts, value-added service projects, etc.) and other measures. If any loss is caused to EZEJ, EZEJ reserves the right to pursue liability.
10. Order
10.1 When you process the order, please carefully confirm the name, price, quantity, model, specification, size, contact address, telephone number, consignee and other information of the order. If there is any inconsistency between the information provided by the consignee and that provided by you to the EZEJ Platform, the actions of the Consignee shall be deemed to be your actions and representations, and you shall be jointly and severally liable for the legal consequences arising from the actions and representations of the Consignee.
10.2 When you design on the EZEJ platform and place an order, you must ensure that the clarity, integrity and resolution of the pictures uploaded to the EZEJ platform meet the requirements of related products on the EZEJ platform (refer to the production process requirements and picture requirements of EZEJ products); If the pictures you provide cannot meet the requirements of EZEJ production process, resulting in problems in the finished product, EZEJ does not assume any responsibility.
10.3 If the goods customized on the EZEJ platform have problems caused by your own reasons, the EZEJ platform does not support return or exchange of goods.
10.4 Subject to laws and regulations, the EZEJ Platform will review the user's order and arrange delivery after approval. If any content or information in the order (such as user-customized content, etc.) violates the relevant laws, regulations and policies of the People's Republic of China, this Agreement and the rules of EZEJ Platform, EZEJ has the right to cancel the order or refuse service, and all losses and responsibilities caused by it shall be borne by the user.
10.5 The information on the EZEJ platform (including but not limited to price, product description, etc.), although we try our best to ensure its accuracy, it may also be wrong due to personnel operation or system problems, in which case we will confirm and modify with you according to the correct information, and you can cancel the order or transact with EZEJ according to the correct information. We apologize for the inconvenience.
10.6 Unless otherwise mandatory by law, the Parties agree as follows: The commodity and price information displayed on the EZEJ platform is only the release of transaction information and does not constitute an offer. You must fill in the quantity of the commodity, consignee, contact information, delivery address and other contents of the order when processing the order; The order information generated by the system is the data automatically generated by the computer information system according to the content you fill in, and is only the trading offer you make to us; After we receive your order information, you will only be deemed to have entered into a transaction relationship with us in relation to the actual delivery of the goods (marked by the delivery of the goods); If you have multiple items in one order and we only ship some of the items to you, you have entered into a trading relationship with us only for the items actually shipped; A trading relationship between you and us with respect to the other goods in the order that have been actually shipped is only established if we have actually shipped the other goods in the order. You can log in to your "EZEJ Treasure" account registered on the EZEJ Platform at any time to check the status of your order.
10.7 Your order processing and other acts on the Platform shall not involve malicious order processing of goods and services, malicious rights protection and other acts that disrupt the normal trading order of the EZEJ Platform. Based on the need to maintain the trading order and transaction security of the EZEJ platform, EZEJ may take the initiative to close relevant trading orders and other operations when it finds the above situation, and reserves the right to pursue compensation.
11. Delivery and receipt of goods
11.1 Before submitting the order, please confirm your delivery address again. If the goods are redelivered due to your incorrect address filling, we have the right to charge logistics fees according to the actual delivery times.
11.2 EZEJ will deliver the goods (goods) to the delivery address specified by you. All delivery times listed on the Platform are reference times. The calculation of reference times is estimated based on the production status, normal processing process, delivery time and delivery place, and does not represent the actual delivery time of the goods (goods) to the delivery address specified by you.
11.3 EZEJ is not a direct logistics carrier, but in order to facilitate your delivery of goods (goods), EZEJ can connect you with logistics carriers that provide logistics services (including user-owned logistics). Therefore, EZEJ shall not be liable for compensation for delayed delivery if, for example, an order is delayed or unable to be delivered due to:
* The information provided by the user is wrong, the address is not detailed, etc.
* No one signs for the delivery of the goods or the recipient refuses to accept, resulting in the inability to deliver or delay the delivery;
* Mail loss, delay, damage compensation, customs inspection;
* Situation change, natural disaster, war and other uncontrollable factors;
* Damage/loss/delay of goods not caused by the EZEJ platform;
* For specific responsibilities, please refer to the relevant regulations of the logistics company corresponding to the delivery method.
11.4 If the recipient address provided by you is wrong, unknown, the goods contain prohibited items or other reasons cause the return of the shipment, the relevant transportation costs incurred shall be borne by you.
12. Billing information
12.1 Invoices for order payments, shipping costs, etc. generated by you on the EZEJ Platform will be invoiced by the EZEJ Platform based on the actual amount paid. You should provide the platform with real, legal and effective billing information in a timely manner. If you fail to provide it in time for any reason, the Platform has the right to apply to the tax authorities for uninvoiced income, and the relevant responsibilities arising therefrom shall be borne by you.
12.2 If the recipient address provided by you is wrong or unknown, the goods contain forbidden items or other reasons, the relevant transportation expenses incurred shall be borne by you.
13. Ownership and Intellectual Property Rights
13.1 You have the right to enjoy the personalized customization services provided by the EZEJ Platform, that is, by uploading customized materials to the EZEJ Platform (hereinafter referred to as "customized materials"), commissioning and authorizing EZEJ to use customized materials to print and process the basic products provided by the EZEJ Platform, and obtaining personalized products containing customized materials. You hereby represent and warrant that you have all the necessary rights to the customized materials submitted to EZEJ, including but not limited to Copyrights, trademarks, designs and other legitimate intellectual property rights or the legal authorization of the above rights, without infringing on the legitimate rights and interests of any third party, and undertake to indemnify EZEJ platform for all losses caused by customized materials.
13.2 The EZEJ Platform allows the platform creators to upload materials to the EZEJ Platform (hereinafter referred to as "Creator's works") and display and sell them in the designated areas. You have the right to obtain permission from the creators to use the legitimate rights and interests of the creator's works (including but not limited to copyright, trademark, design and other intellectual property rights). Moreover, EZEJ shall be entrusted and authorized to process and customize the basic products provided by EZEJ platform according to the works of the creators, and obtain the processed goods containing the works of the creators. EZEJ only provides the platform services for transactions between the Creator and you in respect of the Creator's work, does not directly participate in such transactions, assumes no responsibility or liability for the legality of such transactions and the Creator's work, and the Creator and you hereby represent and warrant that it has all necessary rights in the Creator's work provided to EZEJ for processing. Including but not limited to copyright, trademark, design and other legitimate intellectual property rights or the legal authorization of the above rights, does not infringe on the legitimate rights and interests of any third party, and undertakes to indemnify EZEJ platform for all losses caused by the creator's works. If there is any dispute or conflict between you and the creator regarding the creation, it shall be settled by friendly negotiation between you and the creator. If no settlement can be reached through negotiation, you and the creator shall have the right to settle the dispute through litigation or arbitration. EZEJ Platform is not responsible for any dispute between you and the creator. If you or/and the creator really need EZEJ platform to provide assistance/provide relevant supporting documents, you or/and the creator should provide the relevant legal documents to the platform, the platform will provide you with the first time.
13.3 If you violate the representations, warranties and commitments made in this Agreement, publish or transmit on the EZEJ platform any information, customized materials or creator's works that infringe upon the legitimate rights and interests of third parties (including but not limited to copyright, trademark, design, patent and other intellectual property rights), you shall bear all legal responsibilities independently in your own name. And shall ensure that EZEJ is exempt from liability. If EZEJ suffers any loss, claim, claim or liability as a result of your breach of any representations, warranties or undertakings made by EZEJ in this Agreement, EZEJ shall have the right to recover from you in full, and you shall use your best efforts to cooperate with EZEJ by all necessary means to avoid or mitigate the loss. This includes, but is not limited to, a title statement and witness testimony that EZEJ has exercised reasonable care.
13.4 Once you accept this Agreement, it means that you take the initiative to transfer any property rights and other transferable rights of any form of information content (including but not limited to customer consultation, product customization, various topic articles and other information content) published by you on this platform at any time. If copyright, property rights (including but not limited to reproduction, distribution, rental, exhibition, performance, projection, broadcasting, information network communication, filming, adaptation, translation, assembly and other transferable rights that should be enjoyed by the copyright owner) are all irrevocably licensed to EZEJ.
13.5 EZEJ is the producer of the EZEJ Platform and owns the copyright and other legal rights of the content and resources of the platform, which is protected by national laws. Ezej has the right to modify this Agreement and the content of the Platform from time to time, and make announcements/releases on the Platform without further notice to users. To the maximum extent permitted by law, EZEJ reserves the right of final interpretation of this Agreement and the content of this Platform.
13.6 Unless otherwise mandatory by law, without the express written permission of EZEJ, no entity/individual shall, in any way, illegally copy, reproduce, quote, link, grab or otherwise use the information content of the Platform, in whole or in part; otherwise, EZEJ shall have the right to hold it legally liable.
13.7 All material and information posted on this platform (such as text, graphics, logos, button ICONS, images, audio clips, digital downloads, data compilations, and software) is the property of EZEJ or its content suppliers and protected by United States and international copyright laws. The compilation of all content on this platform is the exclusive property of EZEJ and protected by United States and international copyright laws. All software on this platform is the property of EZEJ or its software suppliers and protected by United States and international copyright laws.
13.8 Any legal rights owned/owned/authorized by EZEJ, such as EZEJ's trademarks, trade appearance and product images, shall not be used in relation to any products/images/services that are not owned by EZEJ.
13.9 No entity or individual may upload, download, post, email, sell or otherwise distribute through any channel any content that is copyrighted by EZEJ or its content providers.
13.10 If you believe that the content of the EZEJ Platform or the content provided by others has infringed your legal rights (such as copyright, trademark, patent or other rights), please contact the EZEJ official in time and provide the following information:
* Proof of ownership and electronic or personal signature of the owner;
* Description of copyright works, trademarks, patents and/or other rights infringed;
* A description of the infringing content located on our website;
* Your name, address, telephone number and E-mail address;
* Your statement that it is not authorized by the copyright/trademark/patent owner, agent or the law;
* Your statement confirming that the above information is accurate and correct, and that you have the right to represent the owner/right holder of the legal rights involved, and undertake to assume all legal responsibility for any false, incorrect, false information in the information you provide.
13.11 No entity or individual may, without the express written permission of EZEJ, reproduce, republish, sell, resell or use the material information posted on the EZEJ Platform for other commercial purposes or in any public media.
13.12 The EZEJ Platform reserves the right to suspend the release, production or directly remove the product in respect of the intellectual property related issues involved.
14. Service restriction and termination
14.1 You shall be deemed to have breached the contract under any of the following circumstances:
* Violation of relevant laws, regulations and policies of the People's Republic of China when using EZEJ Platform services;
* Breach of this Agreement or other supplementary agreements of the EZEJ Platform;
* The EZEJ Platform considers that your conduct is similar/related to the above two provisions.
14.2 In order to adapt to the development of e-commerce and meet the demand of a large number of users for efficient and quality services, you understand and agree that EZEJ may specify procedures and criteria for breach of contract determination in the EZEJ Platform Rules. For example: EZEJ may determine whether you constitute a breach of contract based on the relationship between your user data and the massive user data; You have the obligation to fully prove and reasonably explain your data anomalies, otherwise it will be considered a breach of contract.
14.3 If the information you post on the EZEJ platform constitutes a breach of contract, EZEJ may immediately delete or block the relevant information according to the relevant rules.
14.4 If your actions on the EZEJ Platform, or actions that are not carried out on the EZEJ Platform but have an impact on the EZEJ Platform and its users constitute a breach, EZEJ may suspend/terminate the provision of some or all of the Services to you in accordance with the relevant rules. If your conduct constitutes a fundamental breach, EZEJ may seize/cancel your "EZEJ Treasure" account and terminate the service provided to you.
14.5 When your breach of contract is combined with certain circumstances such as fraud, selling counterfeit goods, or misusing other people's accounts, or when you endanger the security of other people's transactions or account security, EZEJ will take compulsory measures such as termination of service and access to your "EZEJ Bao" account and IP address according to the risk degree of your behavior. If your behavior causes damage to others or EZEJ Platform, EZEJ reserves the right to hold you responsible.
14.6 EZEJ reserves the right to restrict some or all of the privileges or functions of your account and cancel outstanding orders in relation to any of the following situations:
* Repeatedly publish advertisements, insults and other information unrelated to the products sold, or repeatedly make negative comments with malicious intent;
* Using the EZEJ platform to maliciously claim or complain, verbally or personally attack EZEJ or its staff without cause;
* Other situations where the EZEJ Platform deems relevant action necessary.
14.7 EZEJ may discontinue one or more services at any time in accordance with strategic planning or market conditions, and EZEJ shall not be liable to any individual or third party except as otherwise provided by law. If you object to any of the terms of this Agreement or subsequent amendments to the Terms of this Agreement, or are dissatisfied with EZEJ's services, you may exercise the following rights:
* No longer use any services of the EZEJ Platform;
* Notify EZEJ to stop providing services to you. Upon termination of the Services between the Platform and you, your right to use the Services of the EZEJ Platform will terminate immediately. Upon termination, EZEJ shall have no obligation to transmit or provide to you or third parties any information resulting from your use of the EZEJ Platform Services.
14.8 In the following circumstances, EZEJ has the right to terminate this Agreement directly by cancelling the user's "EZEJ Bao" account, and has the right to permanently freeze or cancel the rights of your account on the EZEJ Platform and withdraw the right to use your account:
* You affect the normal operation of the EZEJ Platform or affect the services provided by the EZEJ Platform to other users through cyber attacks, mass advertising and other actions;
* You have repeatedly (twice or more) exploited the vulnerabilities of the EZEJ platform to place orders maliciously and seek profits;
* You illegally obtain various kinds of virtual property used for EZEJ platform through plug-in tools, network attacks or other improper activities (EZEJ has the right to freeze and liquidate the illegal account without prior notice, and reserves the right to pursue the relevant personnel for legal responsibility);
* The user information you provide (including but not limited to name, telephone number, ID number, email address, etc.) is untrue, inaccurate or incomplete;
* When this Agreement and all rules of the EZEJ Platform are changed, you expressly and notify EZEJ that you do not wish to accept such changes;
* You have other illegal activities that affect the normal operation of the website.
14.9 You agree to fully compensate EZEJ, creators, merchants or other third parties for any loss caused by your violation of this Agreement, including but not limited to attorney's fees, legal costs, direct losses, indirect losses, etc.
14.10 EZEJ may publish on the EZEJ platform information on the measures taken to deal with your above breach of contract and other illegal information confirmed by legal documents in force by national administrative or judicial authorities.
14.11 Upon termination of this Agreement, EZEJ shall not be obliged to disclose any information in your "EZEJ Treasure" account to you or a third party designated by you, except as expressly required by law.
14.12 After the termination of this Agreement, EZEJ may decide whether or not to close any trade orders you have placed during the duration of this Agreement at the wish of the counterparty to the transaction; If the counterparty requires continued performance, you shall continue to perform this Agreement and the terms of the trading order in respect of such trading order, and bear any losses or additional costs arising therefrom.
15. Limitation of Liability and non-commitment guarantee
15.1 EZEJ is responsible for providing the EZEJ Platform Services to you "as is" and "as available". EZEJ undertakes the basic guarantee obligations in accordance with the law, but cannot be liable for the damage caused to you by the maintenance of information network equipment, connection failures, computer, communication or other system failures, power failures, strikes, riots, fires, floods, storms and other natural disasters, explosions, wars, government acts, orders of judicial administrative authorities or by third parties.
15.2 Unless expressly stated otherwise in writing, all information, content, materials, products (including software) and services provided to you by the EZEJ Platform are provided on an "as is" and "as available" basis.
15.3 Unless otherwise expressly stated in writing, EZEJ makes no representations or warranties of any kind, express or implied, regarding the operation of the EZEJ Platform and the information, content, materials, products (including software) or services contained therein (except as otherwise provided in accordance with the laws of the People's Republic of China).
15.4 EZEJ does not warrant that all information, content, materials, products (including software) and services contained and provided by EZEJ, its servers or emails or messages sent from the Platform are free of viruses or other harmful components.
15.5 If the EZEJ platform system crashes or cannot be used normally due to force majeure or other reasons beyond EZEJ's control, resulting in transaction failure or loss of relevant information and records, EZEJ Platform shall enjoy the right of immunity, and EZEJ will make reasonable efforts to assist in dealing with the aftermath.
15.6 You understand and agree that in the customer service mediation service, the customer service of EZEJ Platform is not a professional, and can only judge the credentials submitted by users based on ordinary people's cognition. EZEJ Platform does not guarantee that the decision of Dispute mediation will meet your expectations, and EZEJ Platform shall not be liable for the decision of dispute mediation unless there is intentional or gross negligence clearly stipulated by law.
16. Application of law, jurisdiction and other
16.1 The conclusion, validity, interpretation, amendment, supplement, termination, execution and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China. If not required by law, refer to business practices and/or industry practices.
16.2 Any dispute arising out of your use of the EZEJ Platform Services and in connection with the EZEJ Platform Services shall be settled by EZEJ in consultation with you. If the negotiation fails, both parties agree to file a lawsuit with the people's court with jurisdiction in the place where Shangrao EZEJ Technology Co., Ltd. is domicile.
16.3 Any provision of this Agreement shall be deemed invalid, void or unenforceable, and such provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions of this Agreement.
16.4 EZEJ respects the legal rights of users and consumers. This Agreement and various rules, statements and other contents published on the EZEJ platform are intended to provide better and more convenient services for users and consumers. This platform welcomes users and all sectors of society to put forward comments and suggestions, EZEJ will humbly accept and timely modify this agreement and various rules on the EZEJ platform.
16.5 The terms in this Agreement are marked in bold, please read them carefully.
16.6 By registering as a user of the EZEJ Platform, you are deemed to have fully accepted this Agreement and your rights and obligations under this Agreement.
EZEJ Platform reserves the right of final interpretation of this clause.
